On February 27, 2012, CMS published a final rule that implements an ACA provision establishing transparency and public notice procedures for experimental, pilot, and demonstration projects approved under section 1115 of the Social Security Act relating to Medicaid and the Children’s Health Insurance Program (CHIP). The rule is intended to expand publicly-available information about Medicaid and CHIP demonstration applications and approved demonstration projects and promote greater transparency in the review and approval of demonstrations. The rule requires public notice and comment opportunities related to section 1115 waiver applications at both the state and federal levels. It also codifies statutory requirements pertaining to notification of Indian tribes regarding section 1115 demonstration projects. The rule is effective April 27, 2012.
