The OIG has issued its Semiannual Report to Congress for the period of April 1, 2011 through September 30, 2011. The OIG reports expected recoveries of approximately $5.2 billion for all of fiscal year (FY) 2011, including $627.8 million in audit receivables and $4.6 billion in investigative receivables (including $952 million in non-HHS investigative receivables). During FY 2011, the OIG reports 723 criminal actions for crimes against HHS programs; 382 civil actions (including false claims and unjust-enrichment lawsuits filed in federal district court, civil monetary penalty settlements, and administrative recoveries related to provider self-disclosure matters), and exclusion of 2,662 individuals and entities from participating in federal health care programs. The report also provides an update on, among other things: major OIG enforcement initiatives (including Health Care Fraud Prevention and Enforcement Action Team (HEAT) activities); significant settlement agreements; investigative and audit findings; and a compilation of public proposals for new and modified safe harbors to the Anti-Kickback Statute.
