The OIG has issued two reports on the extent to which Medicare providers and plans offered language access services consistent with HHS Culturally and Linguistically Appropriate Services in Health Care (CLAS) standards. The first report concluded that that 69% of Medicare providers conducted the four-factor assessment recommended by the HHS Office for Civil Rights (OCR) for determining what language access services to offer. However, only 33% of providers offered services meeting all four CLAS standards on language access services (providing such services during all business hours; providing verbal offers and written notices of right to language access services; assuring the competence of language assistance provided by staff; and providing written materials and signage translated into appropriate languages). Similarly, the OIG reports that 88% of Medicare plans conducted the four-factor OCR assessment, but only 67% offered services consistent with all four CLAS language access services standards.
