MedPAC Votes on 2011 Medicare Provider Update Recommendations

The Medicare Payment Advisory Commission (MedPAC) recently voted on recommendations it will make to Congress regarding Medicare payment updates for 2011. At the meeting, MedPAC voted to recommend increasing acute inpatient and outpatient prospective payment system reimbursement in 2011 by the projected rate of increase in the hospital market basket index (MBI). This rate increase would be coupled with implementation of a quality incentive payment program, along with an offset in 2011 through 2013 to recover payments attributable to hospital documentation and coding improvements. MedPAC also recommends that Congress increase payments for physician services in 2011 by 1.0%. For ambulatory surgical centers (ASCs), MedPAC recommends a 0.6% increase in rates, together with a requirement that ASCs to submit cost and quality data. MedPAC recommends updating the end stage renal disease (ESRD) composite rate by the ESRD MBI increase minus a productivity growth adjustment. MedPAC approved a series of recommendations regarding home health services, including elimination of the inflation update for 2011, rebasing of home health rates with provisions to protect quality of care, development of quality outcomes measures, and implementation of certain program integrity safeguards. With regard to other post-acute services, MedPAC recommends no payment update in 2011 for skilled nursing facilities, inpatient rehabilitation facilities, or long-term care hospitals. MedPAC also recommends updating hospice rates by the projected MBI for 2011, minus an adjustment for productivity gains. These recommendations will be included in MedPAC's March 2010 report to Congress. While the recommendations are not binding, MedPAC’s assessments often help shape federal policy.

A number of Congressional committees have held hearings recently on health policy issues. Among other things, two panels held hearings on H1N1 vaccine supply issues -- the House Energy and Commerce Committee and the Senate Homeland Security and Governmental Affairs Committee. The Energy and Commerce Health Subcommittee also held a hearing on recent breast cancer screening recommendations. Also, the Senate Energy and Natural Resources Committee held a hearing on H.R. 3276, the American Medical Isotopes Production Act of 2009.  Looking ahead, on December 8, the Energy and Commerce Health Subcommittee is holding a hearing entitled "Prescription Drug Price Inflation: Are Prices Rising Too Fast?”

A number of Congressional committees have held hearings recently on health policy issues, including a Senate Health, Education, Labor, and Pensions hearing examining increasing health costs facing small businesses and a House Appropriations Committee “briefing” on the "2009 H1N1 Influenza Pandemic: Examining the Federal, State, and Local Public Health Response." In addition, on November 18, 2009, the House Energy and Commerce Committee has scheduled a hearing on “H1N1 Preparedness: An Overview of Vaccine Production and Distribution.”

On September 29, 2009, the House Oversight and Government Reform Committee is holding a hearing on the "Administration's Flu Vaccine Program: Health, Safety, and Distribution." On September 30, the Senate HELP Committee is scheduled to vote on the “Ryan White HIV/AIDS Treatment Extension Act of 2009.” Also on September 30, the Senate VA Committee is holding a hearing on VA's contracts for health servicesthe Aging Committee will examine how successful health systems keep costs low and quality highand the Senate Homeland Security Committee is holding a hearing on controlled substance abuse in Medicaid. On October 1, the Senate Judiciary Committee is scheduled to vote on S. 369, the "Preserve Access to Affordable Generics Act."

Pandemic Influenza Preparedness

The OIG has issued two reports on pandemic influenza preparedness. The first report determines the extent to which selected states and localities have prepared for a medical surge in response to an influenza pandemic and have conducted and documented exercises that test their medical surge preparedness. The OIG found that while progress is being made, more needs to be done to improve states' and localities' ability to respond to an influenza pandemic. The second report, which examines vaccine and antiviral drug distribution and dispensing, again concludes that while the majority of selected localities had begun planning to distribute and dispense vaccines and antiviral drugs, more needs to be done to improve localities' ability to respond to an influenza pandemic.
