According to a recent OIG report, “Obstacles to Collection of Millions in Medicare Overpayments Audit,” CMS has not collected the majority of overpayments (approximately $332 million out of $416 million) identified in OIG audit reports during the 30-month period ended March 31, 2009 that CMS had agreed to collect. Collections were limited by the statute of limitations on overpayment collections, inadequate CMS guidance to contractors on collecting overpayments, and a lack of an effective system for monitoring its contractors’ collection efforts. The OIG also notes that it could not verify the $84 million in overpayments that CMS did report collecting. Among other recommendations, the OIG calls on CMS to pursue legislation to extend the statute of limitations so that the recovery period exceeds the reopening period for Medicare payments and to make a number of improvements to recordkeeping practices.
