As has been widely reported, last week the Supreme Court heard oral arguments on the constitutionality of the ACA’s individual health insurance mandate and whether, if the mandate is unconstitutional, it may be severed from the remainder of the law. In addition, the Court considered whether the challenge to the mandate is premature under the Anti-Injunction Act, along with a separate challenge to the ACA on the grounds that “it coerces States into accepting onerous conditions that it could not impose directly by threatening to withhold all federal funding” under Medicaid.  The Court is expected to rule on the cases in June.
